Terms of Service

By creating an account on 5K Marketplace ("5K", "the Platform", "we", "us"), you confirm that you have read, understood, and agreed to these Terms of Service. If you do not agree, please do not use the platform. These terms apply to all users of the platform including clients (job posters), freelancers, and administrators. We reserve the right to update these terms at any time, and continued use of the platform after any changes constitutes acceptance of the new terms.

To use 5K Marketplace, you must: • Be at least 18 years of age • Have the legal capacity to enter into a binding contract • Not be prohibited from using the platform under applicable Nigerian or international law • Provide accurate, current, and complete information during registration By registering, you represent and warrant that you meet all eligibility requirements.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@5kmarketplace.org if you become aware of any unauthorized use of your account. You may not: • Create more than one account per person • Share your account with any other person • Use another user's account without their permission • Use a false identity or impersonate any person or entity We reserve the right to suspend or terminate accounts that violate these rules.

5K Marketplace uses an escrow-based payment system to protect both clients and freelancers. Here is how it works: • When a client approves a freelancer's proposal, they are required to deposit the agreed amount into 5K's escrow, powered by Paystack • Funds are held securely and are not accessible to either party until the job is completed and approved • Upon client approval of the delivered work, funds are released to the freelancer's in-app wallet, minus the applicable platform fee • If a dispute is raised, funds remain locked until the dispute is resolved by our admin team 5K Marketplace acts as a neutral custodian of escrow funds and is not a party to the underlying service agreement between client and freelancer.

5K Marketplace charges the following fees: • Standard jobs: 10% of the agreed contract amount, deducted at the time of fund release • High-value jobs (₦500,000 and above): 7% of the agreed contract amount • Subscription tiers: ₦2,000/month (Basic), ₦5,000/month (Pro), ₦10,000/month (Unlimited) All fees are non-refundable once a transaction has been completed. In the event of a full refund to the client due to non-delivery or dispute resolution, no platform fee is charged.

All users agree not to: • Post false, misleading, or fraudulent job listings or proposals • Use the platform for any illegal activity • Harass, threaten, or abuse other users • Attempt to circumvent the escrow system by soliciting payments outside the platform • Post spam, duplicate listings, or irrelevant content • Use automated tools to scrape, access, or interact with the platform • Upload malicious code, viruses, or any harmful content Violations of these conduct rules may result in immediate account suspension or permanent ban, at our sole discretion.

5K Marketplace operates a trust and safety system that includes user-initiated reports. The platform enforces the following automated rules: • A job listing receiving 3 or more reports for the same reason will be automatically removed from public listing. The poster will be notified with the reason. • A user receiving 3 reports will be flagged for admin review • A user receiving 5 reports will be temporarily suspended pending admin review Dismissed reports do not count toward thresholds. False reporting is itself a violation of these terms and may result in the reporter's account being restricted. All admin moderation decisions are logged with full audit trails and can be appealed by contacting support@5kmarketplace.org.

All content you submit to 5K Marketplace — including job descriptions, proposals, portfolio links, and messages — remains your intellectual property. By posting content on the platform, you grant 5K Marketplace a non-exclusive, royalty-free licence to display that content as part of the platform's normal operation. The 5K Marketplace platform itself — including its codebase, design, branding, and systems — is the intellectual property of Puden and may not be copied, reproduced, or used without explicit written permission.

When a dispute is raised on a contract, the following process applies: • The raising party submits a description of the issue through the platform • Both parties are notified immediately • Funds remain locked in escrow for the duration of the dispute • Our admin team reviews the contract details, chat history, and delivery evidence within 48 hours • The admin may resolve the dispute in one of three ways: full release to the freelancer, full refund to the client, or a proportional split • Both parties are notified of the resolution 5K Marketplace's dispute resolution decisions are final within the platform. For legal disputes beyond the platform's scope, Nigerian law applies and the courts of Nigeria have jurisdiction.

Freelancer earnings are credited to their 5K in-app wallet upon contract completion. The following conditions apply to withdrawals: • Minimum withdrawal amount is ₦2,000 • Withdrawals are processed via Paystack Transfer API to the user's registered Nigerian bank account • Users must complete bank detail onboarding before a withdrawal can be initiated • Withdrawals typically process within 24 hours • 5K Marketplace is not responsible for delays caused by banking system failures or incorrect bank account information provided by the user In the event of a failed transfer, the withdrawn amount is returned to the user's wallet.

5K Marketplace provides the platform as a service to facilitate connections between clients and freelancers. We are not a party to the underlying service agreements between users. To the maximum extent permitted by Nigerian law: • 5K Marketplace is not liable for the quality, safety, or legality of jobs posted or services delivered • 5K Marketplace is not liable for any indirect, incidental, or consequential damages arising from platform use • Our total liability in any matter is limited to the fees paid to us in the three months preceding the claim We do not guarantee continuous, uninterrupted access to the platform and are not liable for temporary outages.

You may delete your account at any time by contacting support@5kmarketplace.org. Upon deletion: • Your profile will be removed from public view within 24 hours • Your data will be soft-deleted and permanently purged after 30 days • Any active contracts must be completed or resolved before account deletion is processed • Any wallet balance must be withdrawn before deletion; unclaimed balances held after 90 days of account deletion notice will be forfeited 5K Marketplace reserves the right to terminate any account, with or without notice, for violations of these terms.

These Terms of Service are governed by the laws of the Federal Republic of Nigeria. Any disputes arising out of or related to these terms or your use of the platform shall be subject to the exclusive jurisdiction of the Nigerian courts. These terms comply with the Nigeria Data Protection Act 2023 (NDPA) and the Cybercrimes (Prohibition, Prevention, etc.) Act 2015.
